The main focus of our advice is on

• Drafting contracts: We help you to draft service and employment contracts in a legally secure manner and tailor them to the specific needs and requirements of the position in question. Our experience shows that the right contractual basis helps you to work together successfully and avoid disputes in the event of a separation.
• Terminations: German employment law makes it more difficult for employers to terminate an employment relationship than almost any other legal system within or outside Europe. It is essential that all requirements for termination are met before the notice of termination is given. We help you to create the purely formal and substantive requirements in order to implement a termination that has become necessary as successfully as possible. Our aim is to minimize the risk of high severance payments.
• Works constitution law: For many employers, the establishment of a works council and the associated obligations represent the spectre of German employment law. We show you whether and where exactly this fear can be justified and help you to fulfill the formal requirements of works constitution law and to find a constructive way of dealing with the works council.
• Restructuring and other operational changes: In a company with a works council, measures such as the closure of a plant, the relocation of a production facility or the introduction of new working methods often constitute operational changes within the meaning of works constitution law. In this case, negotiations with the works council are necessary, whereby the time factor often plays a decisive role. We help you to implement your company's objectives as planned in constructive negotiations with the works council.
• Mergers & Acquisitions: The success of many companies is not based solely on organic growth, but often also on the strategic acquisition or sale of companies or parts of companies. In such a case, the acquirer quickly finds itself as the employer of many unknown employment relationships and the seller as a potential contact for old employment contract liabilities. We help you to better assess risks (e.g. as part of a due diligence review) and create legal certainty at an early stage.
